What information must the contract contain

In general, a real estate sale-purchase contract must contain information about the property sold, its exact address, number of rooms, built area, but also the useful one, cadastral number, how to acquire the property (inheritance, donation, purchase) , but also the price of the property (in numbers and letters). The method of payment and the currency in which the payment will be made will also be mentioned.

Necessary documents and documents

In order to realize a real estate sale-purchase contract, the following documents will be needed:

  • Identity documents for the seller and the buyer;
  • Property deeds;
  • Fiscal certificate issued in the name of the owner stating that he is up to date with payments to the State;
  • Cadastral documentation, ie the property file, the location and survey plan, as well as the tabulation conclusion and so on;
  • Land book extract;
  • Energy performance certificate, a certificate that will be issued only by a certified energy auditor;
  • Certificate issued by the owners / tenants association in case of apartments, certificate proving the situation of debts to the association;
  • The last invoice and receipt for the up-to-date payment of the utilities related to the building.

In the case of legal entities, a certificate of fiscal attestation of the legal entity from ANAF, a certificate of registration with the Trade Register or the act based on which the activity of the legal entity is carried out, a valid certificate from the Trade Register, a power of attorney / GMS delegation / decision if there is a representative of the legal entity at the conclusion of the act and a GMS decision which results in the agreement of the associates regarding the process of selling the property.

Generally, such contracts can be concluded in just three or four days or in two days in an emergency. It will not be necessary for the property documents to be left in original at the notary office.

Fees required for the realization of the contract for the sale and purchase of real estate

Many people wonder how much a sale-purchase contract costs at a notary. In short: it depends. Under the conditions in which the seller will pay for all the above documents to be issued, plus the state tax, the payment of the notarial expenses will be returned to the buyer.

The minimum fee charged by a notary office for the authentication of the contract is provided in ANNEX No. 2 of the Order of the Ministry of Justice No. 46 / C / 2011. The payment amount will be calculated in installments, taking into account the value of the good to be sold.

In addition to the above fee, the buyer must also pay the tabulation fee to the National Agency for Cadastre and Real Estate Advertising. This tax has a percentage of 0.15% of the total price of the apartment. The tabulation will be made by the notary on behalf of the new owner after the sale-purchase contract has been concluded.

If the services of a real estate agency have been used, both the buyer and the seller will pay a commission.

In addition to information about documents and fees, you need to know a few details.

Current regulations

According to the norms in force, the original sale-purchase contract will remain in the archives of the notary office as a security measure. The parties will receive a duplicate with the same function as the original, only it does not contain the signatures of the notary, the buyer and the seller. If this document is lost, the notary may issue another duplicate, but not the original.

The buyer will be called in approximately 10 days from the authentication of the sale-purchase deed to take possession of the land book extract and the conclusion of the registration in the land book of the property right.

Energy Performance Indicator

Another aspect that is worth considering when buying a property is the energy performance indicator. Depending on this, the building falls into a class from A to G. In order to achieve this classification, the total energy consumption of the building will be taken into account and the way in which energy is saved in the building will be analyzed.

To be classified in energy class A, a building must:

  • to have a maximum consumption of 125 kWh / m2 / year;
  • to have the consumption of energy from non-renewable sources (kWh / m2 / year) equal to zero;
  • to provide lighting with LED sources;
  • to automate the heating installation;
  • to automate the hot water consumption installation (by mounting the flow meters on the hot water and cold water connections);
  • to have well-insulated thermal installations;
  • to have thermally insulated exterior walls;
  • to have efficient carpentry.

All of the above information will be collected and verified by an authorized auditor. The Aqua City project was designed to fit into energy class A.
